By initiating lessons with AVS you are agreeing to the following policies.
1. Parties.
This Agreement is entered into on by and between Arabella Voice Studio, hereinafter referred to as the “AVS”, and Student(s).
2. Purpose.
The purpose of this Agreement is to establish the terms and conditions under which Students of AVS must abide by.
3. Website Pop-up Agreement.
The parties agree that when Student agrees to said pop-up agreement on “www.arabellavoicestudio.com”, agreeing to pop-up prompt acts as a legal binding signature.
4. Payment and Credit Card Policy.
Student authorizes AVS to keep Student credit card or other financial information on file and to post charges to such account for any fees accrued by Student at AVS. Student may not reserve a lesson time until payment information is on file. AVS reserves the right to charge the Student payment method on file if a lesson is cancelled within less than a twenty-four (24) hour time period.
5. Cancellation Policy.
No refunds will be given for cancelled lessons. Cancelled lessons within twenty-four (24) hour notice may be eligible for credit or coach changes contingent upon notification and meeting specified conditions.
I. Private Lessons. Should a Student sign up for private lessons and wants to cancel any lesson, Student must provide notice of cancellation via the listed instructor at least twenty-four (24) hours before the scheduled private lesson. If a Student fails to notify of cancellation at least twenty-four (24) hours before the lesson, Student must pay the full lesson fee.
II. Group Lessons. Should a student sign up for group lessons and wish to cancel any particular lesson, Student must provide notice of cancellation via the listed instructor four (4) hours before the scheduled group lesson. Should a Student fail to notify AVS of such cancellation within such a time period, the student must pay the full lesson fee.
6. Late Arrival Policy for Private Lessons.
Student must notify teacher if Student will arrive more than 15 minutes late. If Student does not notify teacher, Student must forfeit the lesson time.
7. Administrative Fees.
Student may switch to an in person lesson from a virtual lesson for an additional $25 administrative fee with twenty-four (24) hour notice. Likewise, students may switch to a virtual lesson at any time, but there will be no price adjustment from the studio rate.
8. Lesson Time & Date.
Although AVS will be diligent in honoring Student lesson times, Student acknowledges that they are purchasing lesson credits and this does not guarantee them a certain teacher, date, or time.
9. Lesson Expiration.
Students will receive the agreed upon number of lessons. Students must use lessons within the below timeframes:
I. A la carte lessons: Student will forfeit any lessons not booked within 30 days of payment.
II. Lesson Packages: Student will forfeit any lessons not booked within 60 days of payment.
10. Guest Passes.
Each student is entitled to four guest passes. Guest passes must be used by different individuals and must be used by the end of the year.
11. Media Release.
Without expectation of compensation or other renumeration, now or in the future, Student gives consent to AVS and agents to use Student name, image, and likeness in any of AVS’s publications, advertising, or any other media activities. The student agrees to hold harmless, release, and forever discharge all claims, demands and causes of action which the student may have by reason of this authorization. This consent includes, but is not limited to: • Film; • Photograph; • Tape; or • Voice recording
12. Alcohol and Drug Policy.
The consumption of alcohol or substances is prohibited in the studio. Student will be asked to leave the premises or log off of virtual lessons if detected under the influence.
13. Governing Law.
This Agreement must be governed under the laws in the State of Massachusetts. 2 of 3
14. Forum Selection.
Any legal action or proceeding with respect to this Agreement or the services provided hereunder must be brought and determined in the state courts of the commonwealth of Massachusetts or the United States District Court for the District of Massachusetts (and may not be brought or determined in any other forum or jurisdiction). Each party submits with regard to any action or proceeding for itself and in respect of its property, generally and unconditionally, to the sole and exclusive jurisdiction of the aforesaid courts.
15. Indemnification.
The Student shall indemnify and hold AVS harmless from any loss or liability arising from under this Agreement.
16. Severability.
This Agreement will remain in effect in the event a section or provision is unenforceable or invalid. All remaining sections and provisions must be deemed legally binding unless a court rules that any such provision or section is invalid or unenforceable, thus, limiting the effect of another provision or section. In such case, the affected provision or section shall be enforced as so limited.
17. Terms and Conditions.
AVS reserves the right to change these terms and conditions. AVS will communicate to Student any potential changes relating to these terms and conditions.
18. Entire Agreement.
This Agreement, along with any attachments or addendums, represents the entire agreement between the parties. Therefore, this Agreement supersedes any prior agreements, promises, conditions, or understandings between AVS and Student.
